Standard terms and conditions and general trading information.
1. These terms and conditions apply to all items and supersedes all others. Receipt of order by you, constitutes your acceptance that our conditions are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.
2. Payment Terms
Payment is required at point of purchase. You can purchase online or pay by card either online or in the Studio. We do not accept buyer’s terms.
3. Title and Copyright: Copyright on all Jill Jones Design or Jill Jones Fine Art remains the copyright to Jill Jones FRSA.
4. Risk: The risk in the goods shall pass to you on delivery.
5: All goods delivered or not, remain our property until payment is received in full.
6. Products online
We reserve the right to alter any details or design of products illustrated without notice and while every effort is made to describe goods accurately online no warranty is given as to accuracy and no responsibility will be accepted for error or misdescription and any resulting loss.
7. Prices
All prices quoted are exclusive of V.A.T. at the current rate, and VAT does not apply on top, as Jill Jones Design is not registered for VAT.
8. Delivery
8.1 Delivery to one UK address is included in the sale of any Jill Jones FRSA original artwork or Giclee Print. Delivery will be charged extra for Greetings cards, according to weight.
8.2: We will happily price you any overseas delivery, providing you have advised us your Postal Code. This is charged extra at the quoted International Postage rate.
8.3: Every effort will be made to deliver on time, but any delivery date specified is a best estimate and no liability is accepted for any loss arising from delay or error in delivery of the goods. All deliveries will be charged at the prevailing rates applying at the date of such delivery. No confirmed delivery estimates can be provided.
8.4 Special rush deliveries can usually be arranged but will usually be subject to additional charges (e.g. express production or delivery)
8.5 If you reject a delivery, our delivery obligation is deemed to have been met. If through rejection, a re-delivery is required, this can not be guaranteed to be within your deadline. Neither will we be liable for any costs arising from re-delivery, which may be at your expense. Furthermore, it is your responsibility advise at time of receipt, of any issues occurring.
9. Claims
9.1 Claims arising from damages, delay or partial loss in transit must be made in writing to us, so as to reach us within 3 days of delivery.
9.2 All claims with regard to the quality or quantity of the goods shall be made in writing to us so as to reach us within 3 days of receipt of goods or such goods shall be deemed to comply as to quality and quantity with the terms of the contract.
9.3 You must examine all goods delivered at the time of delivery. We shall not be liable for any loss arising from damage caused to the goods in transit unless loss or damage is noted on the delivery note at time of delivery.
9.4 Claims in respect of non-delivery must be made in writing so as to reach us within 4 days from receipt of our invoice.
10. Liability
10.1 Save in so far as defects in the goods cause death, injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.
10.2 We can accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the notification of claims procedure set out in clause 10.
10.3 Nothing in these terms and conditions shall affect the right of the consumer.
11. Cancellation Charges
The full charge will be made on cancelled orders. Due to the bespoke nature of individual orders, we do not refund.
In the event of any genuine issue with your art purchased, whilst we do not refund, we may consider exchange for another piece to the value, or a commission piece to the same value. “Change of mind’ is not deemed to be relevant.
Our exchange policy lasts 7 days.
If 7 days have passed since your purchase, we can’t offer you an exchange.
Exchange: To be eligible for an exchange of item your item must be unused and in the same condition that you received it. It must also be in the original packaging.
To complete your exchange, we require a receipt or proof of purchase.
We can not exchange:
- Products with obvious signs of use or change.
- Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
- Any item on which an issue is advised to us more than 7 days after purchase.
In the case of any studio time booked or art class booked, failure to turn up constitutes a cancellation at no notice, therefore 100 % cost will apply. We would be unable to re-book the reserved slot, or offer it for re-sale, therefore this is non-negotiable.
12. Discounted items.
Where an item has been discounted, limited concessions apply. All original paintings or prints will have been “sold as seen” either on view in a gallery location or at the Studio. Items will have all been quality checked prior to dispatching (This is a video’d process for our record) Unless items are irretrievably lost or damaged BEYOND repair, our normal exchange policy will not apply. In addition, additional carrier costs may apply.
